Aquatic Gardens provides pond, fountain, waterfall, pondless waterfall, koi pond, aquatic plant, water feature design, installation, repair, maintenance, and related services in North Carolina.

These Terms apply to your use of our website. Any actual service work, installation, maintenance, repair, or project may also be governed by a separate written estimate, proposal, invoice, maintenance agreement, or contract. If there is a conflict between these website Terms and a signed project agreement, the project agreement will control.

2. Use of Our Website

5. Scheduling and Access

Project and maintenance scheduling depends on weather, site access, material availability, crew availability, customer approvals, and other conditions.

You agree to provide safe and reasonable access to the property, work area, water sources, power sources, gates, driveways, and any areas needed to complete the work.

Aquatic Gardens is not responsible for delays caused by unsafe conditions, restricted access, animals, locked gates, hidden utilities, weather, customer delays, or circumstances outside our control.

6. Customer Responsibilities

You are responsible for:

  • Providing accurate project and property information;

  • Disclosing known leaks, electrical issues, plumbing issues, pond liner damage, unstable rocks, prior repairs, underground utilities, irrigation lines, drainage problems, or other relevant conditions;

  • Securing pets and ensuring safe access to the work area;

  • Obtaining any required HOA approvals unless otherwise agreed in writing;

  • Following care instructions after installation, cleaning, repair, or maintenance;

  • Maintaining proper water levels, pump operation, filtration, water quality, and fish care between service visits.

Aquatic Gardens is not responsible for problems caused by lack of maintenance, improper water levels, power outages, customer changes, third-party work, wildlife, storms, freezing, flooding, neglect, or failure to follow care instructions.

7. Fish, Koi, Plants, and Living Materials

Ponds and water features involve living systems. Fish, koi, aquatic plants, beneficial bacteria, algae levels, and water quality can be affected by many factors outside our control, including temperature, water chemistry, predators, disease, oxygen levels, filtration, customer feeding practices, power outages, and prior pond conditions.

Unless specifically stated in writing, Aquatic Gardens does not guarantee the survival, growth, color, health, or performance of fish, koi, plants, or other living materials.

8. Water Quality and Algae

Aquatic Gardens may provide cleaning, filtration, UV, beneficial bacteria, plant, and maintenance recommendations, but we cannot guarantee perfectly clear water or an algae-free pond at all times.

Water clarity and algae control depend on sunlight, nutrients, runoff, fish load, filtration, water movement, plant coverage, maintenance frequency, and other environmental factors.

9. Permits, Utilities, and Property Conditions

Unless otherwise agreed in writing, the customer is responsible for confirming property lines, easements, HOA requirements, underground utilities, irrigation, drainage, septic systems, electrical lines, plumbing, and other hidden conditions.

Aquatic Gardens is not responsible for damage to unmarked, undisclosed, hidden, or incorrectly marked underground utilities or systems.

10. Changes to Work

Any requested changes to the scope of work may affect pricing, scheduling, materials, and completion time. Aquatic Gardens may require written approval before performing additional work.

Verbal requests may be treated as authorization if confirmed by text, email, invoice, or other written communication.

11. Cancellations and Rescheduling

If you need to cancel or reschedule an appointment, please contact Aquatic Gardens as soon as possible.

Aquatic Gardens may charge a cancellation or rescheduling fee if a customer cancels with short notice, fails to provide access, is not prepared for the appointment, or causes a scheduled crew visit to be unproductive.

Project deposits may be non-refundable if materials have been ordered, scheduling has been reserved, design work has been completed, or preparation work has begun.

12. Warranties

Any warranty for labor, materials, pumps, filters, liners, UV lights, plumbing, lighting, or other equipment will be stated in the written estimate, invoice, manufacturer warranty, or project agreement.

Manufacturer warranties are controlled by the manufacturer’s terms. Aquatic Gardens is not responsible for manufacturer defects beyond any assistance we agree to provide with warranty claims.

Unless stated in writing, Aquatic Gardens does not provide warranties for damage or failures caused by misuse, lack of maintenance, freezing, storms, flooding, animals, rodents, power outages, improper water levels, third-party work, customer modifications, or normal wear and tear.

13. Website Content

The content on this website is for general informational purposes only. While we try to keep information accurate and helpful, we do not guarantee that all website content is complete, current, or error-free.

Examples of results we cannot guarantee unless specifically agreed in writing include permanent leak elimination, complete algae removal, perfect water clarity, exact rock placement appearance, fish survival, plant growth, or long-term equipment performance under all conditions.

18. Limitation of Liability

To the fullest extent allowed by law, Aquatic Gardens will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the website or services.

Our total liability for any claim related to website use shall not exceed the amount you paid to Aquatic Gardens for the specific service giving rise to the claim, if any.
